Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and ServiceNomad ("we," "us," "our") governing your access to and use of the ServiceNomad platform, including our website, mobile applications, and related services (collectively, the "Platform").

BY ACCESSING OR USING THE PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.

2. Description of Service

ServiceNomad operates a digital marketplace platform that connects recreational vehicle (RV) owners ("Customers") with independent mobile RV repair technicians ("Service Providers" or "Technicians"). We provide technology infrastructure, communication tools, and payment processing to facilitate these connections.

IMPORTANT: ServiceNomad is a platform provider only. We do not employ technicians, perform repairs, or guarantee the quality of services. All repair services are provided by independent contractors who operate their own businesses.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 18 years old and legally capable of entering into contracts to use the Platform. By using ServiceNomad, you represent and warrant that you meet these requirements.

3.2 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password and account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access or security breach

3.3 Service Provider Requirements

Service Providers must additionally:

  • Possess valid business licenses and permits required by local jurisdiction
  • Maintain current general liability insurance (minimum $1,000,000 coverage recommended)
  • Pass background checks and identity verification
  • Provide proof of relevant certifications and qualifications
  • Comply with all applicable laws, regulations, and safety standards
  • Maintain accurate availability and service area information

4. User Responsibilities and Conduct

4.1 Acceptable Use

You agree to use the Platform only for lawful purposes. You must not:

  • Violate any laws, regulations, or third-party rights
  • Provide false, misleading, or fraudulent information
  • Impersonate any person or entity
  • Harass, threaten, or abuse other users
  • Circumvent or manipulate our systems, security measures, or pricing
  • Scrape, crawl, or use automated tools to access the Platform
  • Transmit viruses, malware, or harmful code
  • Interfere with or disrupt the Platform's operation
  • Use the Platform to compete with ServiceNomad
  • Contact users outside the Platform to circumvent fees

4.2 Customer Responsibilities

Customers agree to:

  • Provide accurate descriptions of repair needs and RV information
  • Be present or provide authorized access during service appointments
  • Provide safe working conditions and access to necessary utilities
  • Communicate respectfully with Service Providers
  • Pay agreed-upon fees promptly
  • Leave honest, accurate reviews based on actual service experience

4.3 Service Provider Responsibilities

Service Providers agree to:

  • Respond to service requests promptly and professionally
  • Provide accurate quotes, timelines, and service descriptions
  • Perform services in a professional, workmanlike manner
  • Use appropriate tools, equipment, and safety practices
  • Communicate clearly about service progress and any issues
  • Respect customer property and privacy
  • Honor quoted prices unless unforeseen issues arise (with customer approval for changes)
  • Provide warranties or guarantees on work performed as legally required
  • Maintain valid insurance coverage throughout service delivery

5. Booking and Service Agreements

5.1 Service Requests

When a Customer submits a service request, it constitutes an offer to receive quotes from Service Providers. Service Providers may accept or decline requests at their discretion. A binding service agreement is formed when both parties confirm the booking details, price, and service date.

5.2 Independent Contractor Relationship

Service Providers are independent contractors, not employees or agents of ServiceNomad. The relationship between Customers and Service Providers is direct. ServiceNomad is not a party to service agreements and assumes no responsibility for service performance, quality, safety, or outcomes.

5.3 Pricing and Estimates

Service Providers set their own prices. Quotes provided through the Platform are estimates. Final pricing may vary based on actual conditions discovered during service. Service Providers must obtain Customer approval before performing work that exceeds the original estimate by more than 10% or $50, whichever is greater.

5.4 Modifications and Changes

Changes to scheduled services (date, time, scope) must be mutually agreed upon by both parties. ServiceNomad is not responsible for coordinating or enforcing such changes.

6. Payment Terms

6.1 Payment Processing

Payments are processed through our third-party payment processor (Stripe). By providing payment information, you authorize us to charge the agreed-upon amount. You agree to use a valid payment method and ensure sufficient funds are available.

6.2 Platform Fees

ServiceNomad charges a service fee for facilitating connections and processing payments. For Customers, this fee is included in the total price displayed. For Service Providers, a commission (typically 15-20% of the service price) is deducted from payments received.

6.3 Payment Schedule

  • Customers: Payment authorization occurs when booking is confirmed. Funds are captured upon service completion or according to agreed payment terms.
  • Service Providers: Payments are disbursed within 2-5 business days after service completion, minus applicable fees, subject to verification and fraud checks.

6.4 Taxes

You are responsible for all applicable taxes related to your use of the Platform. Service Providers must collect and remit all applicable sales taxes. We may collect tax information as required by law.

6.5 Disputes and Chargebacks

Payment disputes should be resolved directly between Customers and Service Providers. If you initiate a chargeback, we may suspend your account pending investigation. Fraudulent chargebacks may result in permanent account termination and legal action.

7. Cancellations and Refunds

7.1 Customer Cancellations

  • More than 48 hours before service: Full refund minus processing fees ($5 or 3%, whichever is greater)
  • 24-48 hours before service: 50% refund; 50% paid to Service Provider as cancellation fee
  • Less than 24 hours before service: No refund; full payment to Service Provider
  • Emergency situations: Considered on a case-by-case basis with documentation

7.2 Service Provider Cancellations

If a Service Provider cancels, the Customer receives a full refund. Service Providers may face penalties for repeated cancellations, including reduced visibility, higher commission rates, or account suspension.

7.3 Refund Requests

Refund requests based on service quality must be submitted within 7 days of service completion with supporting evidence. ServiceNomad will investigate and make a determination at its sole discretion. Refunds may be full, partial, or denied based on circumstances.

8. Reviews and Ratings

Users may leave reviews and ratings for completed services. Reviews must be honest, accurate, and based on personal experience. You may not:

  • Post false, defamatory, or misleading reviews
  • Leave reviews in exchange for compensation (except the actual service)
  • Post reviews containing profanity, discriminatory language, or personal attacks
  • Include personal contact information or attempt to solicit business outside the Platform

We reserve the right to remove reviews that violate these guidelines. Reviews are opinions of individual users and do not represent ServiceNomad's views.

9. Intellectual Property

9.1 Platform Content

All content on the Platform (text, graphics, logos, code, design) is owned by or licensed to ServiceNomad and protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works without our written permission.

9.2 User Content

You retain ownership of content you submit (photos, descriptions, reviews). By submitting content, you grant ServiceNomad a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute the content in connection with operating and promoting the Platform.

9.3 Trademarks

"ServiceNomad" and related marks are trademarks of ServiceNomad. You may not use our trademarks without prior written consent.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICENOMAD DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding accuracy, reliability, or completeness of content
  • Warranties that the Platform will be uninterrupted, secure, or error-free
  • Warranties regarding the quality, safety, or legality of services provided by Service Providers
  • Warranties regarding credentials, background checks, or qualifications of Service Providers

YOU ACKNOWLEDGE THAT SERVICENOMAD DOES NOT EMPLOY OR CONTROL SERVICE PROVIDERS AND CANNOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF THEIR SERVICES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICENOMAD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or business opportunities
  • Property damage or personal injury resulting from services
  • Quality defects, incomplete work, or warranty claims related to repairs
  • Delays, cancellations, or non-performance by Service Providers
  • Fraudulent activities by users or third parties
  • Unauthorized access to or use of your account or data
  • Disputes between Customers and Service Providers

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT OF FEES YOU PAID TO SERVICENOMAD IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow limitation of liability for personal injury or certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless ServiceNomad, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Platform or violation of these Terms
  • Services provided or received by you through the Platform
  • Your content or any infringement of third-party rights
  • Any injury, death, or property damage caused by services you provided or received
  • Disputes between you and other users
  • Your violation of any law or regulation

13. Dispute Resolution

13.1 Informal Resolution

Before pursuing legal action, you agree to first contact us at legal@servicenomad.app to attempt to resolve the dispute informally for at least 30 days.

13.2 Binding Arbitration

If informal resolution fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), except as modified by these Terms.

  • Arbitration shall be conducted in the county where you reside or in Travis County, Texas
  • The arbitrator's decision is binding and may be entered as a judgment in any court
  • Each party bears their own costs; arbitrator fees are split equally
  • For disputes under $10,000, you may choose document-only arbitration

13.3 Class Action Waiver

YOU AGREE THAT DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS.

13.4 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access. Small claims court disputes are excluded from arbitration if they qualify for that venue.

13.5 Opt-Out

You may opt out of arbitration by sending written notice to legal@servicenomad.app within 30 days of first accepting these Terms.

14. Insurance and Background Checks

14.1 Service Provider Insurance

Service Providers represent that they maintain appropriate insurance coverage. However, ServiceNomad does not verify insurance coverage, limits, or validity. Customers should independently verify insurance before authorizing work.

14.2 Background Checks

ServiceNomad may conduct background checks on Service Providers but does not guarantee their accuracy or completeness. Background checks are not a guarantee of trustworthiness, competence, or safety. You assume all risks associated with interacting with other users.

14.3 No Endorsement

Listing a Service Provider on the Platform does not constitute an endorsement, recommendation, or guarantee by ServiceNomad.

15. Account Termination

15.1 Termination by You

You may terminate your account at any time by contacting support. Termination does not relieve you of obligations for completed transactions or disputes.

15.2 Termination by Us

We may suspend or terminate your account immediately without notice if:

  • You violate these Terms or any law
  • You engage in fraudulent activity
  • You receive excessive negative reviews or complaints
  • Your account poses security or legal risks
  • You attempt to manipulate ratings or circumvent fees

15.3 Effect of Termination

Upon termination, your right to use the Platform ceases. Provisions regarding intellectual property, indemnification, limitation of liability, and dispute resolution survive termination.

16. Modifications to Terms

We may modify these Terms at any time by posting updated Terms on the Platform. Material changes will be communicated via email or prominent notice. Your continued use after changes constitutes acceptance. If you do not agree to changes, you must stop using the Platform.

17. General Provisions

17.1 Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of law principles.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision is modified to the minimum extent necessary to make it enforceable.

17.3 No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

17.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

17.5 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ServiceNomad regarding the Platform.

17.6 Force Majeure

Neither party is liable for delays or failures due to circumstances beyond reasonable control, including natural disasters, pandemics, war, terrorism, labor disputes, or government actions.

17.7 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.
